Terms of service

The agreement between you and Thinkbix Technologies covering your use of pixbix. By creating an account you accept these terms.

1Agreement#

These terms form a binding agreement between you (or the organisation you represent) and Thinkbix Technologies, covering pixbix at pixbix.app, its APIs, mobile applications and related services.

By creating an account, accessing the API, or using the service, you accept these terms. If you are accepting on behalf of an organisation, you confirm you are authorised to bind it.

The acceptable use policy, privacy policy and refund policy form part of this agreement.

2Accounts and workspaces#

You must be at least 18 and provide accurate information. You are responsible for everything that happens under your account and for keeping your credentials secure.

Work belongs to a workspace, not an individual. Whoever holds the owner role controls the workspace, its billing and its members. If you invite people, you are responsible for their use of the service.

API keys act on behalf of your workspace. Treat them as passwords: anyone holding a live key can spend your credits. Revoke a key immediately if it is exposed.

3Your content#

You retain all rights to the templates, media and outputs you create. We claim no ownership.

You grant us a limited, non-exclusive licence to host, process, transmit and display that content solely to operate the service for you. The licence ends when you delete the content or close your account.

You are responsible for having the rights to everything you upload. You confirm that:

  • You own the content, or hold a licence permitting its use
  • Fonts you upload are licensed for server-side rendering and embedding
  • Images, video and audio you supply do not infringe copyright, trademark or personality rights
  • Your content does not violate the acceptable use policy

If you publish a template publicly, you grant other pixbix accounts a licence to render from it while it remains published. Unpublishing stops that going forward but does not retract renders already made.

4Plans, credits and billing#

The service is sold on subscription plans and one-off credit packs. Prices are shown on the pricing page in Indian rupees and include GST unless stated otherwise.

  • Credits are the unit of consumption. Cost is calculated from your request before it runs.
  • Plan credits refill at the start of each period and do not carry over.
  • Purchased credits do not expire while your account is open. We spend plan credits first.
  • Failed renders are not charged. Credits held for a render that fails or is cancelled are returned automatically.
  • Subscriptions renew automatically until cancelled. You authorise us to charge your payment method each period.

If a payment fails we will retry and notify you. If it keeps failing, the workspace returns to the free plan — purchased credits survive, plan credits do not.

We may change prices with at least 30 days’ notice to account holders. Changes take effect at your next renewal, and you may cancel before then.

5Acceptable use#

The acceptable use policy sets out what you may not do. In summary: nothing unlawful, deceptive, infringing, or designed to harm the service or other users.

You also may not:

  • Resell or expose the rendering API as a competing rendering service
  • Circumvent credit metering, plan limits or rate limits
  • Reverse engineer the service, except where that right cannot lawfully be excluded
  • Use the service to generate content that impersonates a real person or organisation deceptively

Building a product that uses pixbix to generate creative for your own customers is expressly permitted and encouraged — that is what the API is for. What is not permitted is repackaging the rendering capability itself as your own rendering API.

6Service availability and changes#

We aim to keep the service available and continuously improved. Paid plans are covered by the service level agreement.

We may modify or discontinue features. For material removals affecting paid plans we give at least 30 days’ notice, and you may cancel and receive a pro-rata refund of the unused period.

Maintenance windows are announced in advance where practical. Emergency security work may be performed without notice.

7Suspension and termination#

You may cancel at any time from billing settings, or close your account entirely.

We may suspend or terminate an account that:

  • Violates these terms or the acceptable use policy
  • Has an unpaid balance after repeated notice
  • Is being used in a way that threatens the security or stability of the service
  • We are legally required to suspend

Except where the law or the severity of a violation requires immediate action, we will contact you first and give you a chance to fix it.

After termination you have 30 days to export your content, after which it is deleted. Records we must retain for legal or tax purposes are kept as described in the privacy policy.

8Warranties and disclaimers#

We provide the service with reasonable skill and care. Beyond that, and to the extent the law allows, the service is provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted or error-free, or that it will meet a requirement we have not specifically agreed in writing.

You are responsible for what you publish. The service renders what your template and your data describe. Reviewing outputs for accuracy, legal compliance and suitability before publication is your responsibility, not ours.

9Limitation of liability#

To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill or data, however caused.

Our total aggregate liability arising out of this agreement is limited to the greater of: the amount you paid us in the twelve months before the claim arose, or ₹10,000.

Nothing here limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.

10Indemnity#

You will indemnify us against third-party claims arising from your content, your use of the service in breach of these terms, or your violation of another party’s rights. We will tell you promptly of any such claim and let you control the defence, cooperating reasonably.

11Confidentiality#

Each party may receive information the other treats as confidential. Both will protect it with at least reasonable care and use it only for this agreement. This does not apply to information that is public, independently developed, or lawfully obtained elsewhere.

12Changes to these terms#

We may update these terms. Material changes are notified to account holders at least 30 days before taking effect. Continuing to use the service after that constitutes acceptance; if you do not agree, cancel before the effective date and we will refund the unused portion of your period.

13Governing law and disputes#

This agreement is governed by the laws of India. The courts of India have exclusive jurisdiction, subject to the following.

Before starting proceedings, both parties agree to attempt resolution in good faith by writing to the other and allowing 30 days to respond. Most disputes end here, and it is far cheaper for everyone.

14General#

  • If any clause is unenforceable, the rest remains in force.
  • Failing to enforce a right is not a waiver of it.
  • You may not assign this agreement without our consent; we may assign it as part of a merger or acquisition.
  • These terms, with the policies referenced in clause 1, are the entire agreement between us.
  • Nothing here creates a partnership, agency or employment relationship.
